1. Authorship and copyright
   The photographer(s) must be the author(s) and copyright holder(s) of the submitted image(s).
2. Single submission
   An image may only be entered once, either as a single image or as part of a photographic series.
3. Submission platform
   All entries must be submitted through Pride Photo’s official contest platform, Picter. Entries submitted by any other means will not be accepted.
4. Previously published work
   Images may be submitted regardless of whether they have previously been published.
5. Captions and information
   All submitted images must include accurate captions in English and contain all information requested as part of the submission. Captions generated using ChatGPT or other generative AI systems will not be accepted.
6. Anonymous judging
   Submitted images must not display the photographer’s name, publication, or other information that identifies the photographer within the image itself.

Artificial Intelligence

7. AI-generated images
   Pride Photo does not accept images created entirely using generative AI. Submitted work must be grounded in photography and the lived realities and experiences of LGBTQIA+ people and communities.
8. AI-assisted or AI-modified images
   AI may be used as a tool within the photographic or artistic process. Any use of AI in the creation, editing, manipulation or modification of submitted work must be clearly declared, including an explanation of how and where AI was used. Pride Photo reserves the right to assess the use of AI on a case-by-case basis and to exclude work where its use is inconsistent with the aims or integrity of the contest.

Eligibility and Organisational Values

9. Content eligibility
   Pride Photo is committed to representing LGBTQIA+ lives and experiences while opposing hatred, racism, homophobia, transphobia, sexism, discrimination, oppression, violence and genocide. In line with these values, submissions that promote, endorse or contribute to discriminatory, hateful, oppressive or exclusionary narratives or perspectives are not eligible. Pride Photo also does not accept work that uses LGBTQIA+ representation as a means of obscuring, legitimising or distracting from discrimination, oppression or violence against other people or communities, including practices commonly referred to as pink-washing. Pride Photo reserves the right to determine whether a submission is consistent with these principles and the aims of the contest.

Copyright and Use of Submitted Work

10. Retention of copyright
    Copyright holders retain copyright in their submitted images.

11. Use by Pride Photo
    Pride Photo may use submitted images in connection with its exhibition(s) and activities directly related to the exhibition(s). Pride Photo will credit the photographer and, where applicable, the title of the work.

12. Licence
    Copyright holders grant Pride Photo a non-exclusive, worldwide licence to use submitted images across media, including online, social media and print, in connection with the contest, exhibition(s), Pride Photo archive, and Pride Photo’s promotional, educational and research activities, without additional remuneration being due.

13. Third-party rights
    The copyright holder represents and warrants that the submission and the rights granted to Pride Photo do not infringe applicable law or the rights of any third party. The copyright holder shall indemnify Pride Photo against third-party claims arising from a breach of this warranty.

14. Consent of persons depicted
    The copyright holder represents and warrants that, where applicable, persons depicted in the submitted work participated without coercion, are aware of the intended submission and public presentation of the work, and have provided the permissions necessary for its exhibition and publication. If the work is selected, Pride Photo may request model release forms for individuals depicted in the submitted images, as well as additional documentation or communication confirming that those individuals are aware of and consent to the use of their likeness within the submitted work.

General Conditions

15. Governing law
    These Terms and Conditions, and any dispute or claim arising from or relating to them, including non-contractual disputes or claims, shall be governed by Dutch law.
16. Jurisdiction
    Any dispute arising from or relating to these Terms and Conditions shall be submitted exclusively to the competent court in Amsterdam, the Netherlands.
17. Acceptance and exclusion
    These Terms and Conditions are binding upon submission. Pride Photo reserves the right to refuse or exclude any submission that does not comply with these Terms and Conditions or the eligibility requirements of the contest.
