Regulations of the ShowOFF Section MONTH OF PHOTOGRAPHY IN KRAKOW 2024.
The organizer of the ShowOFF Section (hereinafter referred to as the "Section") held within the framework of the Krakow Photomonth Festival 2024 (hereinafter referred to as the "Festival") is the Foundation of Visual Arts with its registered office in Krakow (30-513) at Ignacego Krasickiego 21/81, KRS 0000068882 (hereinafter referred to as the "Organizer").
Candidates for the Section (hereinafter referred to as "Candidates") may be individuals who apply to the Section, Candidates may also be art groups. Preference will be given to the projects of debutants, i.e. individuals whose works have never yet been presented in the form of individual or group exhibitions in a leading, opinion-forming art institution (museum or art gallery involved in the promotion of artists) and have never received any award at a festival or other photographic event. Candidates may be natural persons of full legal age (including those active in an art group) who have full legal capacity and who have accepted these Regulations.
Section applications can be submitted until February 18, 2024, 23:59:59 CET by submitting a completed Section application form via the www.picter.com platform (Picter terms of use are available at https://www.picter.com/terms-of-use).
Photographic projects (up to 15 photos) or video projects (original photographic projects and original film projects hereinafter referred to as "Project" / "Projects") may be submitted to the Section. Each Candidate may submit a maximum of two Projects.
3. Candidates are required to pay an administrative application fee payable for all applications to the Section. A one-time administrative application fee, in the amount of:
a. 20 Euros for one Project or 30 Euros for two Projects for applications sent to January 31, 2024 23:59:59 CET;
b. 30 Euros for one Project or 40 Euros for two Projects for applications sent between February 1 and February 18 2024 23:59:59 CET.
Projects submitted to the Section may be completed or in progress. From among the Candidates, the Organizer will select participants who will be qualified to participate in the Section (hereinafter referred to as "Participants"). The Organizer's decision to qualify a given Candidate as a Participant is not subject to appeal. The selection of Participants will be announced in the form of an announcement on the photomonth.com website and on the SM channels of the Photomonth Festival by 26 February 2024 23:59:59 CET.
By sending applications, the Candidate, declares that.
agrees to cooperate with the Organizer in the organization of the Section to the extent and under the terms of these Regulations;
is the creator of the original Project and owns all and unrestricted copyrights; and confirms that the Project is free from claims by third parties, both in its entirety and its individual elements;
agrees to the processing of his personal data by the Organizer for the scope and purposes of recruitment to the Section and the organization of the Section and the Festival;
owns the rights to the images and images contained in the Project and authorizes the Organizer to distribute the images and images used in the Project;
if selected to participate in the Section, the Participant grants the Organizer a license - non-exclusive, free of charge, not subject to termination for a period of 10 years, together with the right to sublicense to the Festival partners and the Organizer, unlimited by territory and language - to use the copyright of the original Project for the purpose of: realization and promotion of the Section, the Month of Photography in Krakow and the Organizer, as well as the partners of the Festival and the Organizer, and in particular grants permission to record and reproduce, publicly exhibit, display, exhibit or use in the press, television, the Internet, profiles on social networks run by the Organizer, the catalog of the Section or the Festival and on CD/DVD media worldwide.

Participants, whose original Projects will be exhibited during the Section in the form of an exhibition (hereinafter referred to as "Presentation"). Exhibition locations for each Presentation will be selected at the based on the deliberations of the jury, the producers of the Festival on behalf of the Organizer in consultation with the Laureates. Laureates will be selected by: February 25 2024 23:59:59 CET.
The selection of Laureates shall be made by Curators (hereinafter referred to as "Curators") selected by the Organizer. The Curators may include representatives of the Organizer. The selection of the Laureates is an autonomous decision of the Curators, which is not subject to appeal by the Participants.
The Laureate undertakes to:
to work with the Organizer and the Organizer's designated Curator of the respective Project (hereinafter referred to as the "Project Curator") to the end and to the extent necessary to organize the Presentation at the premises designated by the Organizer and in accordance with the schedule of the Section;
participate in a meeting with the Project Curator organized by the Organizer at a place and time designated by the Organizer (at the time of writing these Regulations, the meetings are scheduled in Krakow, Poland at March 2024) and scheduled online meetings agreed upon between the respective Project Curator and the Laureate (2-4 meetings during the Section) in consultation with the Organizer.
make available to the Organizer all information, digital files and other materials necessary to organize the Presentation as intended, including the schedule of the Section. It is understood that all materials for the production of the Presentation should be sent to the Organizer by April 30 2024 23:59:59 CET.
produce the Presentation or cooperate with the Organizer in the production of the Presentation at a photo lab of the Organizer's choice (or any other company providing services needed for the Project). As part of this production, in agreement with the Organizer, exhibition copies of the works comprising the Project (hereinafter referred to as the "Works") may be produced, as well as additional author copies of the Works comprising the Project intended for sale;
cover the costs of producing the Presentation, to the extent not covered by the Organizer, in the manner indicated by the Organizer in agreement with the Winner, by June 15 2024;
participation in the opening, conferences, meetings, panels and other events related to the organization of the Section.
5. The Laureate is the owner of the Works comprising the Project, while the Organizer has the right to use these Works free of charge after the end of the Section in the scope, rules, and purpose of the collective or individual presentation of the Project of the Laureate of the Section and promotion of the Project and the Festival. If the Laureate does not collect the Works within two years after the end of the Section, ownership of the Works shall pass to the Organizer.
6. If the Project has not previously been made available to the public, the first public release will take place within the Section at a date and in a manner determined by the Organizer in consultation with the Laureate and the Project Curator. In the event of any reuse of the Project in the future, re-presentation in the form of an exhibition or in any other form, the Laureate undertakes to include in all materials and publications accompanying the re-presentation of the Project a note about its premiere within the framework of the ShowOFF Section organized by the Krakow Photomonth.
The Candidate shall be responsible for any legal defects in the Project and statements of licensing and permissions to distribute the image in the Project. In the event that a third party makes a legitimate claim against the Organizer for violation of copyright, personal rights or other legally protected property. The Candidate agrees to bear the full cost of any legal proceedings, legal fees, and any damages or remedies awarded or agreed upon by the method of settlement.
In the event of a Laureate's delay in fulfilling the obligations specified in the Regulations, the Organizer has the right to suspend the organization of the
Presentation or revoke the title of Section Laureate from the Laureate.
In the event that the Presentation is not organized or is delayed with respect to the schedule of the Section for reasons attributable to the Laureate, the Laureate shall pay to the Organizer a contractual penalty in the amount equivalent to the costs of handling the entire process of realization of the Presentation incurred up to the moment of discontinuation of the Presentation (§3 item 5), which does not exclude the possibility of claiming compensation on general principles.
The Organizer declares that it has the right to suspend the organization of the Presentation and cancel the Presentation in the event of causes beyond the control of the Organizer, i.e., random events, COVID - 19 epidemic, cancellation of funding for the Festival. In such case, after the cessation of the reasons, the Organizer and the Laureate will set a new date for the Presentation taking into account the Organizer's schedule.
The Organizer reserves the right to highlight selected Projects and announce them as part of the official Section Shortlist. Distinction is not equivalent to receiving the title of Laureate and the prize of the Presentation.
The Organizer declares that it will use the granted license with respect for the copyright and personal rights of the Participants and the Laureates.
To the extent not regulated by the Regulations Polish law shall apply.
Any disputes between the Participants and the Organizer shall be resolved exclusively by the court having jurisdiction over the Organizer's registered office.
The Organizer reserves the right to amend these Regulations at any time. If the Regulations are amended, the Candidate will be informed of the changes to the Terms and Conditions via e-mail to the address indicated,
These Regulations shall enter into force on the date of their promulgation.

The Organizer will process the following personal data of Candidates: name, telephone number, e-mail address. Personal data will be processed for the purpose of recruiting for the Section and organizing the Section.
Candidates' personal data are processed based on Article 6(1)(a) of the RODO.
Personal data of Candidates may be transferred to authorized bodies to the extent required by law and to entities providing services related to the organization of the Section and partners of the Organizer.
Personal data of Candidates will be processed for the duration of the Section, the use of Projects. The period of processing may be extended each time by the period of limitation of claims.
Provision of personal data is voluntary, but necessary to participate in the recruitment of the Section and Section. The candidate has the right to withdraw consent to data processing at any time. The withdrawal of consent does not affect the lawfulness of processing that was carried out based on consent before its withdrawal. Consent can be withdrawn by sending a statement of withdrawal of consent to our mailing address or e-mail address.
Candidates have the right: to access the content of the data and to request rectification, erasure, restriction of processing, and the right to object to the processing of the data. If it is determined that personal data is processed unlawfully, Candidates have the right to lodge a complaint with the supervisory authority, which is the President of the Office for Personal Data Protection.
