Polaroid x Magnum Open Call

Participation

1. Welcome to the Polaroid x Magnum Open Call on Picter (the Open Call). We’re glad that you would like to participate!

2. The Open Call is organized by Polaroid International B.V., with registered address at Danzigerkade 16 C, 1013 AP, Amsterdam, Netherlands) (Polaroid) and Magnum Photos, with registered address at 12 West 31st Street, New York, NY 10001, United States (Magnum).

3. You are reading these terms because you would like to participate in the Open Call.

4. By participating in the Open Call, you affirm that you have read, understand, and accept these terms, as well as the terms and condition of Picter, which can be viewed here: https://www.picter.com/terms-of-use

5. Please note that you are only eligible for a prize if you comply with our terms in full.

6. The Open Call is open to all photographers which are 18+, provided that Polaroid and Magnum employees and their immediate family members are unfortunately excluded.

7. Participation in the Open Call is free, so no need to make any purchase.

What you need to do

8. To enter the Open Call, you should:

• Go to https://site.picter.com/polaroid-magnum-open-call-2024
• Submit the following: Your photography portfolio, consisting of two separate photo stories, with up to 15 images per story, and a supporting project description per story. A 50-word project proposal of a photo story you want to capture and why (in English).

9. The Open Call is open for entries from July 15, 2024 to August 12, 2024.

10. Your entry can consist of analog, instant, as well as digital photos.

11. You may submit a maximum of 1 entry. Only the first entry will be valid.

12. Your entry should meet the following requirements:

a. the content must be your own original creation;

b. you own or have obtained all necessary rights to the content;

c. the content does not infringe any third-party rights, like tradenames, trademarks, copyrights or portray rights;

d. you have obtained talent/model releases from all people visible in the content;

e. the content, of parts thereof, cannot be generated through artificial intelligence;

f. the content may not have a defamatory character;

g. the content may not portray or depict any person product or company in a false light;

h. The content may not be objectionable (content that shows criminal behavior, violence, sexual abuse, sexual solicitation, adult nudity, offering or linking to alcohol, tobacco, firearms, pornographic or adult-themed material, gambling or drugs etc.);

i. any children depicted in the content must be yours, or you must have obtained written permission from the legal guardian of the child to submit the content in the Open Call); and

j. the content may not otherwise violate any laws.

Selection process

13. Polaroid and Magnum will select 10 entries as winners.

14. The winners shall be selected based on the following selection criteria for the entries: (i) storytelling, and (ii) creativity.

15. The winners will be announced ultimately on August 26, 2024 by Magnum via email or the Picter platform.

Prizes

16. If your entry is selected as one of the winners you will win the following prizes:

• 1x Polaroid I-2 Camera, with a value of EUR 699,99;
• 12x pack of Polaroid i-type film, with a value of EUR 239,88; and
• Magnum mentorship, consisting of 3 online sessions (of approx. 2 hours) with a Magnum photographer and the other winners, which will take place on August 28, 2024, September 4, 2024 and September 11, 2024.

17. The winners shall be available on aforementioned dates to participate in the Magnum mentorship.

18. During the Magnum mentorship, the winners will be asked to create and submit at least five Polaroid photos on the theme ‘Real Life is not black and white” (the Work).

19. Winners will get the opportunity to feature a selection of the Work on Polaroid’s online channels (such as website, social media, app, and e-newsletter) and Magnum’s Instagram Learn channel.

20. The prizes will be shipped DDP to your registered address at our costs. The delivery time will depend on your place of residence.

License – Winning Entry

21. If your entry is selected as one of the winners, you hereby grant to Polaroid and Magnum the non-exclusive, irrevocable, royalty-free, worldwide right for a period of 5 years to commercially use your entry and the Work (together with your name) on Polaroid’s online channels (including website, social media, app and, e-newsletter), Magnum’s Instagram Learn channel and in educational talks and presentations. All use shall be in the context of the Open Call. You will retain the ownership and any possible intellectual property rights to your entry and the Work.

22. The winners may be contacted by Polaroid to agree to a new license (including payment) to cover public display of the work during an Out of Home campaign.

Other Terms

23. Your personal details will solely be processed in the context of the Open Call to allow us to select the winners and to award the prizes. We also refer to Polaroid’s, Magnum’s and Picter’s privacy policy’s for more information of how we handle your personal data.

24. You shall be solely liable for any damage resulting from the use of your entry and the Work by or on behalf of Polaroid and Magnum. You will indemnify Polaroid, Magnum and any third party identified by Polaroid or Magnum from any damages incurred as a result of the use of your entry and the Work.

25. Prizes that are undelivered, unclaimed or returned to us will be deemed unwanted and the prize will be forfeited. The prize will not be re-allocated.

26. The prizes are not transferable or substitutable and no cash alternatives will be provided.

27. Any taxes or promotional fees are due by the winners.

28. Polaroid and Magnum reserve the right to cancel this Open Call for any reason at any time without liability.

29. Polaroid and Magnum will not correspond with any entry regarding any unsuccessful application.

30. Polaroid and Magnum will be the final arbiter in any decisions regarding the Open Call, and these will be binding. In the unhoped event you have a complaint about the Open Call, please reach out to our customer service team by email (service@polaroid.com).

31. These T&C shall be governed by Dutch law and all disputes in connection to the Open Call will be submitted to the exclusive jurisdiction of the court of Amsterdam, the Netherlands.
