Der Greif GbR, a non-profit organization located at Atelierstr. 18, 81671 Munich, Germany, recognized by German law (hereinafter referred to as "Der Greif") and Münchner Kammerspiele, a distinguished theater situated at Münchner Kammerspiele, Falckenbergstr. 2, 80539 München (hereinafter referred to as "Kammerspiele"), are joining forces to creatively showcase the annual theme of Münchner Kammerspiele for the 2024/2025 season. This partnership aims to visualize the theme through curated photographs, which will be featured across various platforms including online, print media, and city-wide publications, among others. Curator for this collaboration is Çağla Ilk, co-director of the Kunsthalle Baden-Baden and curator of the German Pavilion at the Venice Art Biennale 2024, in collaboration with Der Greif.
By submitting photographs to Der Greif, you acknowledge and agree to the following terms. These terms constitute an agreement between you and Der Greif. The entire submission and selection process is facilitated by Picter GmbH (picter.com, hereinafter referred to as "Picter"), and you are required to create an account at Picter and submit your work through Picter to Der Greif. You agree that both Picter's Terms of Use and Privacy Policy supplement these terms and can be viewed at https://www.picter.com/terms-of-use.
The theme for the open call is "Off to Elsewhere" (in German: "Auf nach Woanders").
The deadline for submitting is April 18, 2024 (23:59 UTC+1). Der Greif reserves the right to change this deadline at any time.
Submissions have a non-compulsory donation of €12.00. If you are unable or unwilling to pay the donation, you may request a voucher for a free submission at voucher-special@dergreif.org. The donation assists Der Greif in covering the expenses of this submission opportunity, not generating profits.
You can submit a restricted number of photographs into one category: Project A, which is 1-5 photographs.
A detailed explanation of each step can be found on the introduction page of the submission process on Picter.
Upon the selection of your image(s), you will be presented with two licensing options, allowing your work to be utilized by Der Greif with the possibility of extending this license to Münchner Kammerspiele under specific conditions.
Option 1: Granting a full, non-revocable, non-exclusive license, applicable across all formats, effective until the end of 2028. This comprehensive licensing agreement allows your work to be used by Der Greif and Münchner Kammerspiele in any media or format without restriction, ensuring your image can be featured in various publications and platforms while retaining your rights to use the image elsewhere.
For Option 1, you will receive a one-time honorarium of EUR 600,00 per selected image, net of VAT.
Option 2: Granting a limited, non-revocable, non-exclusive license in permitting your image to be included in a specific print publication produced by Der Greif and Münchner Kammerspiele. This publication, not intended for sale, will be available at Münchner Kammerspiele venues to complement the season's theme. The print run and format—whether a magazine, book, postcards, or other mediums—are at the sole discretion of Der Greif. This option focuses on a tangible, physical showcase of your work in a context closely tied to the artistic narrative of the season.
For Option 2, you will receive a one-time honorarium of EUR 100,00 per selected image, net of VAT.
If your image(s) is(are) selected, you agree to enter into a further license agreement to effect the above in the form provided by Der Greif.
Der Greif and Kammerspiele will honor your contribution by crediting you with your name or, should you prefer, your pseudonym (artist's name), depending on what is practical and feasible given the publication medium. Additionally, where possible, your URL will be included as an optional acknowledgment.
You consent to Der Greif's and Kammerspiele's exclusive right to decide how your selected photographs are displayed, acknowledging that your images may be juxtaposed with others, creating new narratives either in solitude or in combination.
If your work is selected for publication in a print publication, you will receive a complimentary copy of it, shipped at no charge to the postal address you provided during the submission process.
You agree that your photographs will be archived, irrespective of selection and publication. Should you wish to revoke this consent (for photographs that have not been licensed and selected), you may do so via email to »info@dergreif.org«. Upon revocation, the respective photographs will be deleted immediately following the conclusion of the project. Any works not chosen for publication by either Der Greif or Kammerspiele will remain unused in any capacity, ensuring that you retain full ownership and rights.
You bear full responsibility for the photographs you submit. Under no circumstances may the images contravene any applicable law or public policy of any jurisdiction or any third party rights (refer to paragraph 5.2 of the Picter Terms of Use at https://www.picter.com/terms-of-use).
Only your full name, or, should you prefer, your pseudonym (artist's name) and respective URL, will be published in the media specified under section 5.1. Der Greif's Privacy Policy applies where applicable and can be found at https://dergreif.org/privacy-policy.
All personal data provided during the registration and submission process will be stored for submission management, image administration, curation, organization, and statistical analysis. Any collection of statistical data will be conducted and utilized only in anonymized form. The Privacy Policies of both Picter (https://www.picter.com/privacy-policy) and Der Greif (https://dergreif.org/privacy-policy) are applicable.
You declare that you hold the sole copyright to all submitted photographs and agree to submit images from third parties only with explicit authorization from the respective copyright owners.
You confirm that you have obtained written consent, known as model releases, from all individuals depicted in the submitted photographs, or their legal guardians in the case of minors, allowing you to submit and license these images under the specified terms and for the purposes mentioned above. Additionally, you commit to providing these model releases to Der Greif upon request.
For street or public photography, you accept all responsibility for the display and further processing of your submitted photographs. Moreover, where relevant, you declare the right to submit images of places, buildings, landscapes, military sites or operations, means of transport, goods, and persons for publication as outlined in these terms.
You affirm your sole responsibility for the submitted photographs and agree to indemnify Der Greif and Kammerspiele against any claims, losses, damages, or liabilities arising from your breach of these terms. This indemnity covers not only third-party claims but also any losses or damages incurred by Der Greif and Kammerspiele, including actions of any regulatory authorities.
The ineffectiveness or invalidity of one or more provisions of these terms does not affect the validity of the remaining clauses. Where feasible, any ineffective or invalid provision will be modified to reflect the original intent of the parties as closely as possible.
The place of general jurisdiction is Munich, Germany, and German law will be applied.
