1 Conditions of Participation

By submitting photographs/videos/portfolio items to Picter you acknowledge and agree to the following Conditions of Participation. These conditions constitute an agreement between you and Picter GmbH, registered at Hans-Preißinger-Str. 8, Halle A, 81379 Munich, Germany (hereinafter referred to as "Picter"). The entire submission and selection process is facilitated by Picter and you are required to create an account at Picter. You agree that both Picter's Terms of Use and Privacy Policy supplement these Conditions of Participation and can be viewed at https://www.picter.com/terms-of-use.

2 PURPOSE OF SUBMISSION

Picter.com is a global platform, created to discover the best unrepresented talent and partner them with brands, advertising and creative agencies looking to commission top creative experts in multiple creative disciplines.

The aim of your submission is to be eligible for lucrative job opportunities we will offer in collaboration with renowned global brands and companies. To be considered, your portfolio must be precise and be included in our database. Once you become a part of our database, we will present you to potential clients, and upon approval, you will have the freedom to accept or decline these opportunities at your discretion.

3 PARTICIPATION FEES

Submissions are for free.

4 SUBMITTABLE CONTENT

You can submit up to 3 projects per skill representing your portfolio. You need to be able to show significant competency and expertise in the selected skill set to be considered.

5 USE OF FILES AND PROFILE INFORMATION

By submitting content, we at Picter GmbH will only be vetting work and portfolios to be considered for closed projects. These portfolio’s will be handled with confidentiality.

6 COMMISSIONING

Once a brief comes in, we will follow a due process: We will curate a team to tackle the brief. Picter will breakdown creative requirements.

  • Source vetted creatives and their portfolios to be invited to a brief onboarding session.
  • You as the creative can then choose to accept project details and sign NDA and contract
  • Based on requirements you will be given instructions on timelines and deliverables
  • Depending on the level of the brief requirement there will be three levels of ideation (sparks, accelerators & concepts ) where you, the creator, will receive a fixed compensation for each idea between 250€ - 1000€.

7 REPRESENTATION

Our service is designed to help creators move their career forward and focuses on creatives who are unrepresented. If you already have a contract with a company/agency, it is your responsibility to clarify whether and to what extent you are allowed to work with us. Please understand that we cannot make any legal or factual clarifications with existing companies/agencies and also cannot check whether our cooperation violates any contractual provisions between you and your company/agency. In case of doubt, please always consult with your company/agency or get the necessary permission to work with us. If you wish to opt-out from our community and no longer be considered for future job opportunities, please inform us at support@picter.com whenever you desire.

8 CONFIDENTIALITY

Your submissions and submitted content shall be treated as confidential by Picter and shall only be disclosed to personnel within the Picter organization and to external stakeholders involved in the specific Picter opportunity to which you have submitted.

9 ARCHIVING

Digital versions of your submitted Content are securely archived. You retain the right to revoke this consent at any time by sending an email to support@picter.com. Upon revocation, your Content will be permanently deleted within 10 business days.

10 DECLARATION OF COPYRIGHT

You declare that you are the sole copyright owner of all submitted photographs/videos/portfolio items and agree to submit photographs/videos/portfolio items from third parties only if you have explicit authorization from the respective copyright holders.

You declare that you have explicit consent from all people who are depicted in the submitted photographs/videos/portfolio items (or their legal guardian in the case of children).

In the case of street or public photography, you assume all responsibility for exhibiting and further processing your submitted photographs. Additionally, if applicable, you declare that you have the right to submit pictures of places, buildings, landscapes, military sites or operations, means of transport, goods, and persons to be exhibited as described in these Conditions of Participation.

11 VIOLATION OF RIGHTS

You shall bear full liability for your submitted Content. Under no circumstances shall any submitted Content violate international law (see also paragraph 5.2 of the Picter Terms of Use at https://www.picter.com/terms-of-use).

12 PERSONAL DATA

You agree that your full name and profile information may be shared only with external stakeholders involved in the specific Picter opportunity. Our Privacy Policy applies and can be found here https://www.picter.com/privacy-policy.

All personal data provided by you during the registration and submission process will be stored for the purposes of image administration, curation, organization, and statistical analysis. Any statistical data collection will be conducted in anonymized forms only. We comply with all EU GDPR regulations.

13 DISCLAIMER

You warrant to be completely liable for your submitted Content and indemnify Picter from any claims from third parties caused by the violation of these Conditions of Participation.

14 SEVERANCE CLAUSE

The unenforceability or invalidity of one or more clauses in these Conditions of Participation shall not affect any other clause in these Conditions of Participation. If possible, any unenforceable or invalid clause in these Conditions of Participation shall be modified to reflect the original intention of the parties.

15 JURISDICTION & APPLICATION OF LAW

The place of general jurisdiction is Munich, Germany, and German law will be applied.
